Terms of Service

These terms are an agreement between you (the business that creates an account, "you") and Dakiya ("we", "us"), which operates Dakiya at https://dakiya.smartaccounts.in.
1. The service
Dakiya lets you send and receive WhatsApp messages through your own WhatsApp Business Account on Meta's WhatsApp Business Platform: broadcasts, a shared inbox, automatic replies, contact management and an API. We are an independent software provider. We are not Meta or WhatsApp, and we do not control whether Meta delivers a message, approves a template, or restricts a number.
2. Your account
- You must be 18 or older and able to enter into a contract for your business.
- Keep your password and API keys secret. You are responsible for what is done with them.
- Give accurate business details. One account is for one business unless we agree otherwise.
3. Rules for messaging
You agree to:
- Message only people who have clearly agreed to receive WhatsApp messages from your business, and to keep proof of that consent.
- Honour every opt-out. Contacts who send STOP are unsubscribed by the service and must stay unsubscribed until they opt in again.
- Follow the WhatsApp Business Messaging Policy, WhatsApp Commerce Policy and Meta's terms, and all laws that apply to you, including the Digital Personal Data Protection Act, 2023.
- Not send spam, bought or scraped lists, unlawful, deceptive, hateful, adult or harassing content, or anything that infringes someone else's rights.
We may suspend sending without notice if we reasonably believe these rules are being broken or the account puts other customers or the platform at risk.
4. Message charges and your prepaid balance
- Messages are charged per message at the prices shown in your account under Plan and billing. Prices depend on the message type and the destination country, and include our service charge.
- Charges are taken from a prepaid balance that you top up in advance. When the balance is too low, sending pauses until you add money.
- A message is charged when WhatsApp accepts it. If WhatsApp later reports that it could not be delivered, the charge is returned to your balance automatically.
- Meta changes its own rates from time to time. We may change message prices to match, and will show the new prices in your account before they apply.
- Where your account is set up so that Meta bills you directly for messages, only our service charge is taken from the balance.
5. Plans, payment and renewal
- A free trial runs for the number of days shown at sign-up. No payment is needed to start it.
- Paid plans are prepaid for a month or a year. Prices and limits are shown on the pricing page and in your account, in Indian rupees.
- Plans do not renew automatically. When a plan ends, sending stops until you renew; your data stays available.
- Each plan has limits (for example contacts, messages a month, team members, API calls). When a limit is reached, the related feature pauses until the limit resets or you upgrade.
- Refunds are covered by our Refund Policy.
6. Your data
You own the contacts, messages and other content you put into the service. You give us permission to store and process it only to provide the service to you. Our Privacy Policy explains how. You can export your contacts and reports at any time and can ask us to delete your account and its data.
7. The API
API keys identify your workspace. Stay within the rate limit of your plan, do not try to reach data that is not yours, and do not use the API to build a service that breaks section 3. We may change the API; we will keep version 1 working or give reasonable notice before removing anything.
8. Availability and changes
We work to keep the service running and your data safe, but it is provided "as is", without a guarantee of uninterrupted or error-free operation. We may add, change or remove features. If a change materially reduces what your paid plan includes, you may cancel and receive a refund for the unused part of that period.
9. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, lost profit, or for actions taken by Meta (including blocked numbers, rejected templates or message fees). Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
10. Ending the agreement
You may stop using the service at any time. We may close an account that breaks these terms, or that has been unpaid and inactive for more than 90 days, after writing to the account's email address.
11. Law
These terms are governed by the laws of India. Courts at the place of our registered office have exclusive jurisdiction.
